Abstract

he purpose of conducting research is to find out the legal protection of foreign ownership copyrights that have not been registered in Indonesia. The method used in this study is normative juridical. The results showed that copyright infringement occurred in the manufacture of strip painting logos and painting logo variations in decisions 189 K / Pdt.Sus-HKI (H.C) / 2013. The conclusion, that the copyright violations raised in this writing are violations committed by the intention of the perpetrators to use and register creations in the territory of Indonesia without the right and permission of the actual creator, and in the decision. That the verdict of the Commercial Court and the Supreme Court resulted in legal consequences requiring the creator to lose copyright for the creation of painting logo strips and other variation painting logos in the territory of Indonesia. That a work owned by a foreign citizen must be protected in the territory of Indonesia, whether the creation has been announced or not, based on the provisions stipulated in Law No. 28 of 2014 concerning Copyright. That against the creation of foreigners, the state must protect the provisions of the Copyright Act. Regarding the problem, the author hopes that the government should focus more on protection in the field of copyright both preventive and repressive protection, given that copyright infringement has become commonplace among the people of Indonesia.
