Abstract

In the history of Indonesia development there have been some school of thought in law that existed and developed in Indonesia such as positivism, law of nature, and functional laws. In 1965 has developed functional law and emerged back in 1971. Even, this functional law has become philosophical basis of law development in Indonesia as stated in State Basic Policies (GBHN, 1973). This School of thought in law that state in GBHN is a school of thought that put law as a vehicle for social reform. This is originated from the Prof. Mochtar Kusumaatmadja ideas. This philosophy of law that developed by Prof Mochtar Kusumaatmadja in practice did not produce the law that conceptualized by this school of thought. This is because laws produced by the parliament (DPR) expected to reflect the social justice in reality fail in implementing the mission. The laws that produced, in accordance with Dr. Sutandyo and concluded by Dr. Mahmud MD, even tend to reflect the interest of the ruler rather than the people. Why it could happen? In the writer's view, there are various factors underlying this. One of them is the political configuration. This in the writer's view the weakness of Prof. Mochtar ideas is that this philosophy fragile toward the undemocratic political configuration.
